TEXT MESSAGE TERMS AND CONDITIONS
Individuals may sign up to receive recurring, marketing SMS and MMS text messages (“Texts”) from Connect Hearing, which is part of the Sonova Audiological Care family (“AC US”, “we”, “us”, “our”) , subject to the following Terms and Conditions (“Terms”). Texts may include promotional alerts, new product information, and other content. By signing up to receive Texts, you agree to our Privacy Policy and to be bound by these Terms.
PLEASE READ THESE TERMS CAREFULLY. THESE TERMS AFFECT YOUR LEGAL RIGHTS, INCLUDING BY LIMITING AC US’ LIABILITY AND WAIVING YOUR RIGHT TO ASSERT CLAIMS ON A CLASS OR COLLECTIVE BASIS.
You may opt in to receive recurring promotional Texts from AC US by submitting your information through our online form and ticking the consent box. You consent to the use of electronic recordkeeping to document your opt-in consent.
By signing up to receive Texts, you certify that you (1) are at least the age of majority in the jurisdiction in which you reside, (2) are the account holder of the mobile number you are enrolling, and (3) agree to these Terms and the practices described in our Privacy Policy.
Autodialer or non-autodialer technology may be used to send Texts to the mobile phone number you enroll.
You understand that you are not required to consent to receive marketing Texts as a condition of purchasing any goods or services.
Although Texts are complimentary, message and data rates may apply. Depending on your data plan, your carrier may charge you to receive Texts. You should contact your wireless provider with any questions about your text or data plan.
Generally, you will receive up to 5 Texts per month per subscription, but the number of Texts you receive may vary depending on your interactions with us.
You can stop receiving Texts at any time by replying “STOP” to any Text you have received, or by texting "STOP" to the number from which your received the text. Please note that we may send you one additional message to confirm that you have been unsubscribed.
You agree to provide accurate, complete, and up-to-date information when you sign up for Texts, and that you will notify us immediately at
privacy@sonova.com
if you cease to be the account holder of the mobile number you provided to receive Texts.
AC US does not guarantee the performance or availability of text messaging services, and is not responsible for delayed or undelivered Texts.
AC US Texts may not be available in all areas or supported by all carriers or all devices. Carriers are not liable for delayed or undelivered messages.
Dispute Resolution / Class Action Waiver
In the unlikely event that a disagreement arises between you and AC US with respect to the Texts or these Terms, please first contact AC US directly by emailing
privacy@sonova.com
so that we may work in good faith to find a mutually agreeable solution.
These Terms shall be governed by, construed, and enforced in accordance with local State laws, as it is applied to agreements entered into and to be performed entirely within such state, without regard to conflict of law principles. You agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Texts or these Terms, shall be resolved individually, without resort to any form of class action, exclusively in either the state or Federal courts located in [insert county and state]. You agree to submit to the personal jurisdiction of the courts of the State of Illinois for any cause of action arising out of these Terms. You agree to file any cause of action with respect to these Terms within one year after the cause of action arises. You agree that a cause of action filed after this date is barred.
If any provision of these Terms, or the application thereof to any person or circumstances, is held invalid or unenforceable for any reason, including, but not limited to, the disclaimers and liability limitations, then such provision shall be deemed superseded by a valid, enforceable provision that matches, as closely as possible, the original provision, and the other provisions shall remain in full force and effect.
